These Terms of Service ("Terms") govern your use of the Daniel Electric Company website and services. By accessing our website or engaging our electrical contracting services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By using this website or engaging Daniel Electric Company for electrical contracting services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page.

2. Services Provided

Daniel Electric Company provides commercial, industrial, and multifamily electrical contracting services including but not limited to:

  • Commercial and industrial electrical installations
  • Multifamily residential electrical systems
  • Fire alarm system design, installation, and maintenance
  • Design/build electrical services
  • Electrical service and maintenance
  • Energy efficiency upgrades
  • Government project electrical contracting

All services are performed by licensed and insured electricians in accordance with applicable electrical codes and regulations.

3. Project Estimates and Agreements

Estimates: Project estimates are provided in good faith based on information available at the time. Final costs may vary based on unforeseen conditions, material price changes, or scope modifications.

Written Agreements: All projects require a written service agreement or contract outlining the scope of work, timeline, payment terms, and project specifications. The agreement becomes binding when signed by both parties.

Change Orders: Any changes to the agreed-upon scope of work must be documented in writing through a change order and may result in adjusted pricing and timelines.

4. Payment Terms

Payment terms will be specified in the service agreement and may include:

  • Deposit: A deposit may be required before work commences
  • Progress Payments: Payments may be due at specified project milestones
  • Final Payment: Final payment is due upon project completion and acceptance
  • Late Payments: Late payments may be subject to interest charges as permitted by law

We accept payment via check, wire transfer, or credit card. Payment processing fees may apply for credit card transactions.

5. Project Timelines

We strive to complete all projects within the agreed-upon timeline. However, completion dates may be affected by:

  • Weather conditions and force majeure events
  • Material availability and supply chain delays
  • Unforeseen site conditions or structural issues
  • Changes to project scope requested by the client
  • Permitting and inspection delays
  • Actions or inactions by third parties

We will communicate any anticipated delays promptly and work diligently to minimize project disruptions.

6. Warranties and Guarantees

Workmanship Warranty: We warrant that all work will be performed in a professional and workmanlike manner in accordance with industry standards and applicable codes.

Material Warranties: Materials and equipment carry manufacturer warranties. We will assist in warranty claims as appropriate.

Warranty Period: Specific warranty periods will be outlined in the service agreement. Typical workmanship warranties range from one to two years from project completion.

Warranty Exclusions: Warranties do not cover damage caused by misuse, neglect, unauthorized modifications, acts of nature, or normal wear and tear.

7. Client Responsibilities

Clients are responsible for:

  • Providing accurate project information and specifications
  • Ensuring site access during agreed-upon work hours
  • Obtaining necessary property owner approvals
  • Clearing work areas of personal property and obstructions
  • Providing timely responses to questions and approval requests
  • Making payments according to the agreed schedule
  • Notifying us promptly of any concerns or issues

8. Safety and Site Conditions

Safety is our top priority. We maintain comprehensive safety programs and expect cooperation from all parties on job sites. We reserve the right to suspend work if unsafe conditions are present that are beyond our control.

Clients must inform us of any known hazardous conditions, including but not limited to asbestos, lead paint, or environmental contaminants. Additional costs may apply for work in hazardous environments.

9. Permits and Inspections

Unless otherwise specified in the service agreement, Daniel Electric Company will obtain necessary electrical permits and schedule required inspections. Permit fees are typically separate from labor and material costs and will be itemized in the project estimate.

If work fails inspection due to our workmanship, we will correct the issues at no additional charge. If work fails inspection due to client-requested deviations from code or changes to specifications, additional charges may apply.

10. Limitation of Liability

To the fullest extent permitted by law, Daniel Electric Company's liability is limited to the amount paid for services under the applicable service agreement. We shall not be liable for indirect, incidental, consequential, or special damages including but not limited to lost profits, business interruption, or loss of data.

We carry comprehensive liability insurance and workers' compensation insurance. Insurance information is available upon request.

11. Cancellation and Termination

Client Cancellation: Clients may cancel a project with written notice. Cancellation charges will apply for work performed, materials purchased, and reasonable cancellation fees as outlined in the service agreement.

Our Right to Terminate: We reserve the right to terminate a service agreement for non-payment, unsafe conditions, or violation of these Terms. Client will be billed for work completed through the termination date.

12. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Daniel Electric Company and is protected by copyright and trademark laws. Unauthorized use is prohibited.

Design drawings and electrical plans prepared by us for your project are licensed for use on that specific project only. Reuse on other projects requires written permission.

13. Dispute Resolution

In the event of a dispute, parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

These Terms are governed by the laws of the State of Michigan. Any legal action must be brought in the state or federal courts located in Michigan.

14. Emergency Services

We offer 24/7 emergency electrical services. Emergency service rates are higher than standard rates and will be disclosed at the time of service request. Emergency services are provided on a time-and-materials basis unless otherwise agreed in writing.

15. Subcontractors

We reserve the right to engage qualified subcontractors for specialized work. All subcontractors are required to carry appropriate licenses and insurance. We remain responsible for all work performed by subcontractors on your project.

16. Website Use

This website is provided for informational purposes. While we strive to keep information accurate and current, we make no warranties regarding the completeness or accuracy of website content. Use of this website does not create a client-contractor relationship.

You agree not to use this website for any unlawful purpose or in any way that could damage, disable, or impair the website.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
